Scopwick and Kirkby Green Neighbourhood Plan
On 16 July 2018 North Kesteven District Council resolved to designate the whole of Scopwick and Kirkby Green Parish as a Neighbourhood Plan Area in accordance with the Section 61G of Town and Council Planning Act 1990 (as amended by the Localism Act 2011).
The designation of a Neighbourhood Area being one of the statutory requirements needed to be in place to enable a Neighbourhood Plan to be adopted and formally become a part of the Development Plan, and be used in the determination of planning applications by the District Council.
A draft Scopwick and Kirkby Green Neighbourhood Plan was then prepared and underwent both a local consultation and a formal publicity stage. The draft was then submitted for independent examination.
The examiner’s report concludes that subject to a number of recommended modifications that the Scopwick and Kirkby Green Neighbourhood Plan is able to comply with the ‘basic conditions’ as set out in Paragraph 8(2) of Schedule 4B to the Town and Country Planning Act 1990 as applied to Neighbourhood Plans by section 38A of the Planning and Compulsory Purchase Act 2004, and that the plan could be submitted to referendum in the Parish of Scopwick and Kirkby Green.
NKDC has considered the contents of the Examination Report and concurs with this view. The Scopwick and Kirkby Green Neighbourhood Plan has been modified accordingly and will proceed to referendum on Thursday 19 January 2023 in the Parish of Scopwick and Kirkby Green.
Scopwick and Kirkby Green Parish Council submitted an application to undertake a Neighbourhood Plan. After a four week publication period, this application was approved by North Kesteven District Council on 16 July 2018. The consultation for the area designation received no representations.

A Strategic Environmental Assessment (SEA) and Habitat Regulations Assessment (HRA) screening opinion was prepared by NKDC on behalf of Scopwick and Kirkby Green Parish Council for the draft Neighbourhood Plan. This opinion, that neither a full Strategic Environmental Assessment nor Habitats Regulations Assessment need to be undertaken for the Scopwick and Kirkby Green Neighbourhood Plan was made available to the statutory environmental bodies (Natural England, Historic England and Environment Agency) for comment starting on 9th December 2021. Consultation responses were received from all three bodies who agreed, or raised no objection on this conclusion.
NKDC therefore conclude that neither full Strategic Environmental Assessment nor Habitats Regulation Assessment need to be undertaken for the Scopwick and Kirkby Green Neighbourhood Plan.
Regulation 16 consultation
Scopwick and KG Neighbourhood Plan was submitted to North Kesteven District Council in May 2022 and a period of publicity took place between Friday 17 June until Friday 29 July 2022, during which interested parties were invited to comment on the plan and accompanying documents.

North Kesteven District Council appointed Mr David Kaiserman BA DipTP MRTPI as the Independent Examiner of the Scopwick and Kirkby Green Neighbourhood Plan (SKGNP).
The Examiner assessed whether the SKGNP meets certain legal requirements, known as the ‘basic conditions’ and considered representations made on the SKGNP. An unaccompanied visit to the site took place on the 5 August 2022.

Examiner questions and responses
The examiner has concluded that with minor modifications made the Plan meets the basic conditions and other relevant legal requirements. The Council concurs with this view.
Therefore to meet the requirements of the Localism Act 2011 a referendum which poses the question 'Do you want North Kesteven District Council to use the Neighbourhood Plan for Scopwick and Kirkby Green to help it decide planning applications in the neighbourhood area?' will be held in the Parish of Scopwick and Kirkby Green.
The date on which the referendum will take place is agreed as Thursday 19 January 2023.
The Referendum area is identical to the area designated by Scopwick and Kirkby Green.
