Anti-social behaviour in council properties

As a council tenant, you have the right to live in a safe environment and enjoy your home and local community. North Kesteven District council recognises the impact that Anti-Social behaviour has on residents and has a procedure in place for dealing with nuisance and anti-social behaviour.

Your housing officer can discuss with you remedies available should you be experiencing problems within your community. The council will always seek to resolve any problem through negotiation and mediation where possible, however anti-social behaviour is a breach of your tenancy agreement and therefore the council can and will consider legal enforcement against the perpetrator where it is deemed necessary and appropriate.

The Neighbourhood Services Team work closely with the Anti-Social Behaviour team, Environmental Protection team and the Police to resolve any issues.

Examples of action that the Housing Officer can take to help you include:

  • Offering mediation between the relevant parties.
  • Asking the victim to complete diary sheets.
  • Drawing up ‘good neighbour agreements’ between the parties concerned.
  • Formulating an action plan with the relevant parties.
  • Issuing a warning to the alleged perpetrator.

Following investigations, should the Housing Officer find it to be a serious ASB case then they may:

  • Involve other agencies such as the police or environmental health.
  • Go to court to get the person behaving in an anti-social way evicted. 
  • Apply to court for an injunction.

North Kesteven District Council will only seek to have a tenant evicted for ASB if the behaviour is serious and persistent and all other interventions have failed. To evict an individual, a landlord will also need substantial evidence that it can rely on in court.
