Gaming machine permits for alcohol licensed premises

Premises which are licensed for the sale of alcohol for consumption on the premises may apply for a permit or submit a notification to provide Category C or D Gaming Machines on the premises.

The premises must:

  1. be licensed under the Licensing Act 2003 to sell alcohol for consumption on the premises,
  2. not be subject to any licence requirements that alcohol is to be served only with food, and
  3. have a bar for serving alcohol to customers on the premises.

Premises with no more than two gaming machines

The Premises Licence Holder is required to complete the notification of 2 or less Gaming Machines.   The ‘Premises Licence Holder’ is the person(s) or organisation that holds the Premises Licence, authorising the supply of alcohol at the premises concerned, under the Licensing Act 2003.

There is no expiry date for this entitlement, once we have been notified.  However, should the Premises Licence (Licensing Act 2003) be transferred to a new holder, the notification will lapse and the new holder would need to submit a fresh notification.

There is a one-time fee of £50 to make a notification.

Premises with more than two gaming machines

If it is intended to operate more than 2 Gaming Machines in these licensed premises, then a Licensed Premises Gaming Machine Permit must be obtained from the licensing authority.

The Permit’s duration is indefinite as it is linked to the Premises Licence (Licensing Act 2003).  There is an annual fee to be paid within 30 days of the issue of the Permit, and thereafter annually before each anniversary of the date of issue.

The application fee is £150 and the annual fee is £50.

Machine categories

The Gambling Act 2005 provides for two categories of gaming machines which may be located in alcohol-licensed premises. These are:

Category C

Maximum stake = £1 / Maximum Prize = £100

Category D

Maximum stake = 10p or 30p non-monetary / Maximum prize = £5 cash or £8 non-monetary

All alcohol-licensed premises which provide gaming machines for use on the premises must comply with any relevant Code of Practice issued by the Gambling Commission under s.24 of the Gambling Act 2005. View the the Gaming Machine Code of Practice for alcohol licensed premises.
